Buried deep in this patent application that appears to be about the 28-70mm 2.0, is an embodiment for the 24-70 2.8.  Canon has stated that the 2.8 trinity is coming, possibly as early as this year so seeing patent applications with the 24-70 2.8 should be no great surprise.
